These terms contain the rights, obligations, and stipulations associated with using our mobile app and website. This serves as a binding agreement between Blinkers Nigeria and you. You are required to read the terms and conditions carefully.
A. Blinkers is an online service that allows sellers to list their businesses and services on their mobile applications and website. It allows communication between buyers and sellers using the contact details provided in the seller’s profile.
DISCLAIMER
B. Blinkers Business Directory Limited, who is the owner of Blinkers mobile applications and website is not an importer, manufacturer, distributor, or seller of any item, as well as not a provider of any service posted by sellers on the App. In addition, Blinkers is neither a marketer nor a person acting on seller's behalf with respect to the marketing of any goods or services posted on the App. The actual sale and purchase contracts or services contracts are entered into directly between sellers and buyers and blinkers itself is not a party to such transactions. Blinkers only provides sellers with an opportunity to be seen and reached by buyers.
FEES, SALES AND SERVICES
C. Sellers shall be solely responsible to collect and remit any applicable taxes resulting from the sale of their goods or services posted on the mobile application and website.
D. We reserve the right, in our sole discretion, to change the fees and acceptable payment methods from time to time and for any reason. Note that the fees are non-refundable due to the nature of online services. Your payments for the services are governed by the Blinkers Billing Policy.
Payment for Blinkers subscriptions and services are made through a secure payment gateway (Paystack). Blinkers mobile applications and website do not store bank and card details.
USER RESTRICTION / TERMINATION INFORMATION
E. Blinkers reserves a right to delete or block any posted items by sellers without any notice in the event of
receiving of mandatory judgments of competent public authorities
claim of a holder of intellectual property rights to terminate infringement of his/her rights by a user on the Platform
infringements of rights or legal interests of other users, legal entities, or individuals upon their reasonable request
detecting that announcement posted by user on the Platform breaches these Terms or any applicable law, regulation, rule or standard.
F. Blinkers reserve the right to delete, or block posted items of sellers regardless of providing a seller with the relevant substantiation.
G. Blinkers retains the right to implement any changes to the Services at any time, with or without notice. You acknowledge that a variety of Administrator’s actions may impair or prevent you from accessing the Service at certain times and/or in the same way, for limited periods or permanently, and agree that the Administrator has no responsibility or liability because of any such actions or results, including, without limitation, for the deletion of, or failure to make available to you, any content, or services.
PROHIBITIONS / RULES OF CONDUCTS
H. Blinkers prohibits advert posting that is false, misleading, or deceptive statements.
Also advert that is personal or identifying information about minors or other persons without the proper consent is forbidden.
Pornographic and overly sexual materials are strictly not allowed. Depictions that encourage illegal or reckless use of weapons and dangerous objects or facilitate the purchase of firearms or ammunition are not allowed on Blinkers.
The use defamatory, discriminatory, mean-spirited, threatening or harassing, improper, unacceptable materials, vulgar or abusive language are prohibited. Also, advocacy of hate, violence, discrimination, racism, xenophobia, ethnic conflicts, appeals to violence and unlawful actions are forbidden.
The app strictly forbid adverts relating to offers of prostitution or other services contradicting moral or legal norms. Also, advert related or promoting counterfeit and imitated goods or unauthorized copies. Unauthorized copies include goods having been acquired by illegal means, pirated, or stolen and You will not use software and pursue any other actions aimed to interference with the normal operation of Blinkers App.
The app is strictly against advertisement or promotion of ponzi scheme or any money laundering platform.
You are required to provide only true information about you and your product.
OBJECTIONABLE CONTENT AND USER REMOVAL
I. Blinkers maintains the right to remove any content deemed objectionable, inappropriate, or in violation of these Terms and Conditions. Objectionable content includes but is not limited to:
False, misleading, or deceptive statements.
Personal or identifying information about minors or other individuals without proper consent.
Pornographic or overly sexual materials.
Materials encouraging illegal or reckless use of weapons or dangerous objects.
Defamatory, discriminatory, mean-spirited, threatening, or harassing content.
Improper, unacceptable materials, vulgar or abusive language.
Advocacy of hate, violence, discrimination, racism, xenophobia, ethnic conflicts, appeals to violence, and unlawful actions.
Advertisements relating to offers of prostitution or other services contradicting moral or legal norms.
Promotion of counterfeit and imitated goods or unauthorized copies. Advertisement or promotion of Ponzi schemes or any money laundering platforms.
J. In the case of objectionable content, Blinkers reserves the right to take the following actions:
Immediate removal of objectionable content.
Termination of the user account associated with objectionable content. Also, blinkers will cooperate with law enforcement agencies in this regard. Notably, objectionable contents will be removed within 24 hours.
K. Users are encouraged to report objectionable content promptly through the reporting mechanisms provided within the Blinkers mobile applications and website.
Blinkers shall act diligently upon receiving such reports and reserves the right to investigate, take appropriate actions, and, if necessary, involve relevant authorities.
SELLER AND USER INTERACTION
I. Each seller of the Service is solely responsible for all his or her sellers Content Because we do not control the seller Content, you acknowledge and agree that we are not responsible for any User Content and we make no guarantees regarding the accuracy, currency, suitability, or quality of any User Content, and we assume no responsibility for any User Content. Your interactions with other Service users are solely between you and such user. You agree that the Administrator will not be responsible for any loss or damage incurred as the result of any such interactions. If there is a dispute between you and any Service user, we are under no obligation to become involved.
THIRD PARTY TERMS
J. The Service may contain links to third-party websites or resources and advertisements for third parties (collectively, "Third Party Ads"). Such Third-Party Ads are not under the control of the Blinkers Business Directory and the Blinkers is not responsible for any Third-Party Ads. Blinkers provides these Third-Party Ads only as a convenience and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Ads. Advertisements and other information provided by online properties to which the Third-Party Ads lead, may not be wholly accurate. You acknowledge sole responsibility for and assume all risk arising from your use of any such online properties. When you link to third party online properties, the applicable service provider's terms, and policies, including privacy and data gathering practices, govern. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any third party. Your transactions and other dealings with Third-Party Ads that are found on or through the Service, including payment and delivery of related goods or services, are solely between you and such third party.
K. You hereby release us, our officers, employees, agents, and successors from claims, demands all losses, damages, rights, claims, and actions of any kind including personal injuries, death, and property damage, that is either directly or indirectly related to or arises from any interactions with or conduct of any Service users or any Third-Party Ads.
